SURPLUS PROCEEDS REQUESTS
March 4, 2021 update
The recent Michigan Supreme Court decision will affect the tax foreclosure process in regards to possible surplus proceeds. To make a claim to any surplus funds of foreclosed properties from the 2021 Foreclosures, please refer to the attached form which is provided by the MI Dept of Treasury.

Previous owners of a foreclosed property will not be contacted by the Montcalm County Treasurer's office. It will be your responsibility to file the Notice of Intent.
Notice of closing of the Cemeteries Perpetual Care Funds
NOTICE PURSUANT TO PUBLIC ACT NO.8 OF 2018: AN ACT TO AMEND THE 1903 PA 81,
ENTITLED "AN ACT TO PROVIDE FOR THE CARE AND PRESERVATION OF CEMETERY LOTS,"
Sec.9.(2) of the act directs the treasurer to publish notice of intent to certify
as abandoned the legal interests or rights in money deposited in the perpetual care fund.
The following lots cannot be located and the Care Funds will be transferred to the general fund of the county
if the cemetery lot cannot be located, and the legal interests and rights described in this subdivision are certified as abandoned under this section.
If you know of the location of these lots or can prove you have a legal interest in them, the county treasurer can return the funds to a person or estate.
